{"id":12866,"date":"2023-06-28T00:04:05","date_gmt":"2023-06-28T03:04:05","guid":{"rendered":"https:\/\/cmalaw.com\/brazil-ratifies-treaty-with-singapore\/"},"modified":"2023-06-28T00:04:05","modified_gmt":"2023-06-28T03:04:05","slug":"brazil-ratifies-treaty-with-singapore","status":"publish","type":"contents","link":"https:\/\/cmalaw.com\/homolog\/contents\/brazil-ratifies-treaty-with-singapore\/","title":{"rendered":"Brazil ratifies treaty with Singapore"},"content":{"rendered":"<p>On June 30, 2022, Brazil published Decree No. 11.109\/2022, enacting the treaty for the<\/p>\n<p>avoidance of double taxation and prevention of tax evasion (\u201cDTA\u201d) between Brazil and Singapore, signed on May 7, 2018.<\/p>\n<p>Currently, Brazil has 35 DTAs in effect and the increase in such number is seen as a measure to encourage foreign investments, promote the development of economic and commercial<br \/>\nrelations, foster tax cooperation and curb abusive tax planning.<\/p>\n<p>Under the Preamble and Article 30 of Brazil Decree No. 11.109\/2022, Brazil-Singapore DTA entered into force on December 1, 2021 (at the international level), and will only become effective in Brazil on January 1, 2023. orb) 15% in all other cases.<br \/>\nTreats interest on net equity (INE) as an interest payment<br \/>\nfor treaty purposes (item 4, a of the Protocol to Brazil-<br \/>\nSingapore DTA).<\/p>\n<p>Most Favored Nation clause: if after signing the treaty,<br \/>\nBrazil agrees with another country (excluding any State in<\/p>\n<p>Latin America) on rates that are lower (including<br \/>\nexemptions) than the ones provided for interest, then such<br \/>\nrates shall be automatically extended to Brazil-Singapore<br \/>\nDTA (item 4, d of the Protocol to Brazil-Singapore DTA).<\/td>\n<\/tr>\n<tr style=\"height: 144px;\">\n<td style=\"width: 26.8673%; height: 144px;\">Royalties \u2013 maximum WHT<br \/>\nrate (Article 12)<\/td>\n<td style=\"width: 46.5917%; height: 144px;\">a) 15% for use of trademark.<\/p>\n<p>b) 10% in all other cases, including technical<br \/>\nassistance (item 5 of the Protocol to Brazil-<br \/>\nSingapore DTA).<\/td>\n<\/tr>\n<tr style=\"height: 392px;\">\n<td style=\"width: 26.8673%; height: 392px;\">Technical services \u2013<br \/>\nmaximum WHT rate (Article<br \/>\n13)<\/td>\n<td style=\"width: 46.5917%; height: 392px;\">10% on the payment of compensation for technical<br \/>\nservices.Under Brazil-Singapore DTA, \u201ccompensation for technical<br \/>\nservices\u201d means any payment as consideration for any<br \/>\nservice of a managerial, technical or consulting nature,<br \/>\nunless payment is made:<\/p>\n<p>a) to an employee of the person making the<br \/>\npayment;<\/p>\n<p>b) by virtue of teaching at an educational institution<br \/>\nor teaching provided by an educational institution;<br \/>\nor<\/p>\n<p>c) by an individual for services for the personal use of<br \/>\nan individual.<\/td>\n<\/tr>\n<tr style=\"height: 144px;\">\n<td style=\"width: 26.8673%; height: 144px;\">Capital gains (Article 14) Under Brazilian domestic<br \/>\nlegislation, non-resident capital gains are generally<br \/>\nsubject to WHT at progressive rates from 15%<br \/>\nto 22.5% (except for beneficiaries located in low-<br \/>\ntax jurisdiction, which is subject to the fixed rate of<br \/>\n25%).<\/td>\n<td style=\"width: 46.5917%; height: 512px;\">Entry into Force (Article 30)<\/td>\n<td style=\"width: 46.5917%; height: 512px;\">Each of the Contracting States shall notify the other<br \/>\nthrough diplomatic channels the completion of the<br \/>\nprocedures required by its law for the bringing into force of<br \/>\nthe DTA.The DTA shall enter into force on the date of the reception<br \/>\nof the second of these notifications and its provisions shall have effect in Brazil:<\/p>\n<p>i. in respect of taxes withheld at source, on income<br \/>\npaid, remitted or credited on or after the first day<br \/>\nof January next following the date upon which the<br \/>\nDTA enters into force;
