das solicita\u00e7\u00f5es de cess\u00e3o de uso independente; (ii) promo\u00e7\u00e3o de licita\u00e7\u00e3o p\u00fablica para os processos de cess\u00e3o independente e planejada; (iii) defini\u00e7\u00e3o de formas de apura\u00e7\u00e3o, pagamento e san\u00e7\u00f5es pelo inadimplemento de pagamento devidos \u00e0 Uni\u00e3o.<\/p>\n<p><span data-contrast=\"auto\"><span parte do edital de licita\u00e7\u00e3o e funcionar\u00e1 como instrumento que permite a solicita\u00e7\u00e3o, pelo agente interessado, de licen\u00e7as e autoriza\u00e7\u00f5es de \u00f3rg\u00e3os p\u00fablicos para a implanta\u00e7\u00e3o do projeto de gera\u00e7\u00e3o de energia el\u00e9trica <\/span><\/span><span class=\"TextRun SCXW160714065 BCX9\" lang=\"PT-BR\" xml:lang=\"PT-BR\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW160714065 BCX9\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">A minuta define que ser\u00e1 concedido um prazo de car\u00eancia de no m\u00e1ximo 4 anos para in\u00edcio do pagamento devido a Uni\u00e3o, e o edital de licita\u00e7\u00e3o dever\u00e1 indicar as etapas do empreendimento para concess\u00e3o da car\u00eancia, limitado ao in\u00edcio do comissionamento do empreendimento.\u00a0 No que se refere \u00e0 vig\u00eancia do contrato de cess\u00e3o, tanto para o regime de produ\u00e7\u00e3o independente de energia quanto de autoprodu\u00e7\u00e3o, antes da emiss\u00e3o de outorga da ANEEL, o prazo previsto \u00e9 de 10 anos. Uma vez emitida a outorga do empreendimento, o prazo de vig\u00eancia ser\u00e1 estendido automaticamente.<\/p>\n<p style=\"text-align: justify;\">Ser\u00e3o aplicadas san\u00e7\u00f5es administrativas, sem direito \u00e0 indeniza\u00e7\u00e3o e sem preju\u00edzo da execu\u00e7\u00e3o de garantias aportadas pelo cession\u00e1rio, nas seguintes hip\u00f3teses: (i) descumprimento dos termos o contrato de cess\u00e3o de uso; (ii) utiliza\u00e7\u00e3o do prisma para finalidade diversa daquela para a qual o agente foi autorizado; (iii) n\u00e3o realiza\u00e7\u00e3o dos estudos do potencial energ\u00e9tico offshore ou n\u00e3o implanta\u00e7\u00e3o do projeto no prazo disposto no contrato de cess\u00e3o de uso; e (iv) se extinta a outorga de explora\u00e7\u00e3o do servi\u00e7o de gera\u00e7\u00e3o de energia el\u00e9trica.<\/p>\n<p style=\"text-align: justify;\"><strong>Da Cess\u00e3o de Uso Planejada<\/strong><\/p>\n<p style=\"text-align: justify;\">Os prismas a serem ofertados em procedimento de cess\u00e3o planejada ser\u00e3o identificados e avaliados pela Empresa de Pesquisa Energ\u00e9tica (\u201cEPE\u201d), por iniciativa pr\u00f3pria ou a pedido do MME, observados os crit\u00e9rios estabelecidos na Portaria, tais como, dentre outros: a disponibilidade da \u00e1rea, a competitividade do potencial energ\u00e9tico em rela\u00e7\u00e3o a demais fontes de energia e a exist\u00eancia de estrutura portu\u00e1ria adequada para atender ao empreendimento.<\/p>\n<p style=\"text-align: justify;\">A EPE tamb\u00e9m poder\u00e1 realizar chamada p\u00fablica para identificar interessados em investir na realiza\u00e7\u00e3o de estudos para identifica\u00e7\u00e3o dos prismas. O prazo para emiss\u00e3o da DIP de cada \u00f3rg\u00e3o governamental ser\u00e1 de no m\u00ednimo 30 e no m\u00e1ximo 45 dias, tendo in\u00edcio somente se todos os requisitos da<\/span><span class=\"NormalTextRun SCXW326146 BCX9\"> proposta de<\/span><span class=\"NormalTextRun SCXW326146 BCX9\"> Portaria sejam atendidos.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">Os \u00f3rg\u00e3os governamentais dever\u00e3o avaliar a emiss\u00e3o da DIP considerando o uso m\u00faltiplo do prisma ou possibilidade de coexist\u00eancia de mais de uma atividade. A avalia\u00e7\u00e3o de \u00e1reas que coincidam com os blocos da oferta permanente ser\u00e1 feita pela Ag\u00eancia Nacional do Petr\u00f3leo, G\u00e1s Natural e Biocombust\u00edveis, sendo vedado o uso de \u00e1reas que estejam sob contrato de explora\u00e7\u00e3o e produ\u00e7\u00e3o de petr\u00f3leo e g\u00e1s natural, \u00e1reas arrematadas em licita\u00e7\u00f5es cujos contratos n\u00e3o tenham sido assinados e \u00e1reas pertencentes ao pr\u00e9-sal.<\/p>\n<p style=\"text-align: justify;\">Na hip\u00f3tese de emiss\u00e3o da DIP que aponte interfer\u00eancia no uso do espa\u00e7o f\u00edsico, o \u00f3rg\u00e3o governamental emissor poder\u00e1 prever procedimento de retifica\u00e7\u00e3o e readequa\u00e7\u00e3o do prisma, o agente interessado ter\u00e1 o prazo de 30 dias ap\u00f3s a emiss\u00e3o da DIP para solicitar esta reavalia\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><strong>Do Procedimento Licitat\u00f3rio <\/strong><\/p>\n<p style=\"text-align: justify;\"><span class=\"TextRun SCXW23885053 BCX9\" lang=\"PT-BR\" xml:lang=\"PT-BR\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW23885053 BCX9\">A <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">proposta de regulamenta\u00e7\u00e3o constante na <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">Portaria <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">n\u00ba 685\/2022 <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">estabelece que estar\u00e3o aptos para compor <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">o objeto do processo licitat\u00f3rio os prismas que atenderem os crit\u00e9rios de<\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">:<\/span><span class=\"NormalTextRun SCXW23885053 BCX9\"> (i) <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">disponibilidade da \u00e1rea quanto \u00e0 sobreposi\u00e7\u00e3o e \u00e0 destina\u00e7\u00e3o a outro empreendimento; e (<\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW23885053 BCX9\">ii<\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">) <\/span><span class=\"NormalTextRun SCXW23885053 BCX9\">emiss\u00e3o da DIP com manifesta\u00e7\u00e3o positiva \u00e0 instala\u00e7\u00e3o do empreendimento, de todos \u00f3rg\u00e3os e entidades definidas pelo art. 10 do Decreto.\u00a0<\/span><\/span><span class=\"EOP SCXW23885053 BCX9\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">Uma vez recebida solicita\u00e7\u00e3o de uso dos prismas por meio da cess\u00e3o independente o MME analisar\u00e1 a possibilidade de inclus\u00e3o dessas \u00e1reas nos processos de licita\u00e7\u00e3o de cess\u00e3o de uso peri\u00f3dicos com base nos aspectos definidos na Portaria.<\/p>\n<p style=\"text-align: justify;\">As programa\u00e7\u00f5es e diretrizes para realiza\u00e7\u00e3o do procedimento licitat\u00f3rio para a cess\u00e3o de uso independente e planejada ser\u00e3o definidas em portarias especificas do MME. AANEEL dever\u00e1 definir os crit\u00e9rios de qualifica\u00e7\u00e3o do agente interessado incluindo as credenciais t\u00e9cnicas, operacionais, econ\u00f4mico-financeiras e jur\u00eddicas para a elabora\u00e7\u00e3o do estudo do potencial energ\u00e9tico e a implanta\u00e7\u00e3o, opera\u00e7\u00e3o e descomissionamento do empreendimento.<\/p>\n<p style=\"text-align: justify;\"><strong>Do Estudo de Potencial Energ\u00e9tico Offshore<\/strong><\/p>\n<p style=\"text-align: justify;\"><span class=\"TextRun SCXW114911480 BCX9\" lang=\"PT-BR\" xml:lang=\"PT-BR\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW114911480 BCX9\">Os agentes interessados dever\u00e3o apresentar os estudos de potencial energ\u00e9tico offshore \u00e0 EPE, em conformidade com os requisitos m\u00ednimos da <\/span><span class=\"NormalTextRun SCXW114911480 BCX9\">proposta de regulamenta\u00e7\u00e3o<\/span><span class=\"NormalTextRun SCXW114911480 BCX9\"> e das instru\u00e7\u00f5es da EPE.
