ANTAQ publishes regulation on ship-to-ship operations

On October 29, 2021, the National Agency of Waterway Transportation – ANTAQ published Resolution No. 59/2021-ANTAQ, which regulates ship-to-ship operations (“STS Operations”). This resolution will enter into force on December 1st, 2021.

The new regulation results from analysis carried out by ANTAQ since 2018 and was submitted to a consultation to the market in early 2020, through the Public Consultation No. 01/2020-ANTAQ.

Among other provisions, the new regulation presents technical concepts, establishes the types of navigation performed by vessels involved in STS Operations, and requires the submission of information on monthly handling and average stay of vessels in transshipment areas. The regulation does not require the need to obtain authorization from ANTAQ to carry out STS Operations.

Apart from the new regulation, STS Operations are also regulated by Normative Instruction No. 16/2013 from the Brazilian Institute of the Environment and Renewable Natural Resources – IBAMA, Rules from the Maritime Authority (Normam) No. 08/DPC, and Resolution No. 811/2020 from the National Agency of Petroleum, Natural Gas and Biofuels – ANP.
