LGPD penalties are officially postponed to August 2021
On June 10, the president signed into law the bill of law no. 1,179, which determined, among other issues, the postponement of the penalties set forth in the General Data Protection Law (LGPD) to August 1st, 2021.
With its publication in the Official Gazette on June 12, its text is officially converted into law, now as Law no. 14,010/2020.
The starting date of LGPD effectiveness, however, is not yet definitely defined. Provisional Measure 959/20, which currently postpones the LGPD to May 2021, remains in effect. However, if it is not converted into law before it expires or if rejected by the National Congress, the LGPD effectiveness will return to August 2020, as previously provided.
Thus, at this moment, we have the follow possible scenarios for the LGPD effectiveness:
- Conversion of MP 959/20 into law by Congress: LGPD in effect in May 2021 and penalties in August 2021.
- Congress rejection or expiration of MP 959/20: LGPD in effect in August 2020 and penalties in August 2021.
