IMMEDIATE ENFORCEABILITY OF THE LGPD
The Brazilian President, Jair Bolsonaro, sanctioned yesterday the Provisional Measure (MP) 959/2020, and therefore the General Data Protection Law (LGPD) comes into force today, September 18, 2020.
At the end of August, the Brazilian Senate, in the voting of MP 959/2020 decided to remove the article that provided for the extension of the enforceability of the LGPD, so that it would be in force after the approval or veto of the rest of the MP.
With the sanction of the MP, the LGPD is immediately enforceable, except for the articles related to the National Authority – which were already in force – and the specific sanctions provided for by the law – which were previously extended to August 2021.
We understand that the enforceability of the LGPD was very turbulent since the beginning. Therefore, in case of any doubts, please do not hesitate to contact us.
